Agreement to Terms

These Terms of Service (the "Terms") govern your use of the BookNStyle mobile application and related services (collectively, the "Services") operated by BookNStyle (the "Company," "BookNStyle," "we," or "us"). Our Privacy Policy is incorporated into these Terms by reference.

PLEASE READ THESE TERMS CAREFULLY. THIS IS A LEGAL AGREEMENT BETWEEN BOOKNSTYLE AND YOU. YOUR USE OF THE SERVICES CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS AND YOUR REPRESENTATION THAT YOU ARE AT LEAST 18 YEARS OF AGE. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.

If you accept these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity.

We may update these Terms from time to time. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms. We will update the "Last updated" date when we make changes.

The BookNStyle Services

BookNStyle is a marketplace platform that connects independent personal-care and grooming professionals — including barbers, hairstylists, nail technicians, estheticians, lash technicians, massage therapists, makeup artists, and tattoo artists ("Professionals") — with clients seeking those services ("Clients" or "you"). Professionals and Clients are collectively "Users."

BookNStyle solely provides a platform for Users to connect, schedule, and pay for services. BookNStyle does not provide, perform, or supervise any services. Professionals and Clients contract independently with one another. Each Client is solely responsible for selecting their Professional, the services booked, and the location where services are performed.

BookNStyle does not employ Professionals and does not control the quality, safety, timing, legality, or any other aspect of the services Professionals provide. BookNStyle does not routinely conduct background checks and makes no representation regarding any Professional's licensing, accreditation, or registration. Any decision to provide or receive services is made at each User's sole discretion and risk.

BookNStyle requires Professionals to confirm, at account creation, that they and anyone performing services through their account are appropriately licensed and legally permitted to offer those services, and that geo-verified business addresses are accurate. BookNStyle may, but is not obligated to, remove or hide any inaccurate, outdated, or unlawful content or accounts at any time.

NEITHER THE COMPANY NOR ITS AFFILIATES OR LICENSORS IS RESPONSIBLE FOR THE CONDUCT, WHETHER ONLINE OR OFFLINE, OF ANY USER. YOU RELEASE THE COMPANY AND ITS AFFILIATES FROM ANY LIABILITY RELATED TO USER CONDUCT OR THE SERVICES PERFORMED BY PROFESSIONALS.

While the Services aim to show availability in real time, a scheduling conflict may require a Professional to reschedule. Creating a booking is not a guarantee that the Professional will honor it as scheduled.

Accounts

To use the Services you must create an account and provide true, accurate, current, and complete registration information. You agree to keep this information up to date and not to misrepresent your identity.

You must use your true name and select an appropriate, non-offensive display name. We may reclaim any display name we believe is inappropriate, offensive, confusing, or infringes a third party's rights.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree not to let anyone else use your account, and to notify us immediately of any unauthorized use. We are not liable for any loss arising from unauthorized use of your credentials.

You may link your account to third-party accounts (for example, social or calendar services). Your relationship with those third-party providers is governed solely by your agreements with them. We are not responsible for third-party content or services.

Eligibility and Age Representation

The Services are available only to individuals who are at least 18 years of age. By creating an account — including by checking the box confirming that you are at least 18 years old, or by signing up through a third-party account such as Apple, Google, or Facebook and completing the age confirmation — you represent and warrant to BookNStyle LLC that you are at least 18 years old, that you have the legal capacity to enter into these Terms, and that all information you provide is truthful. We record the date, time, and version of the age confirmation you give and may rely on it.

BookNStyle LLC relies on your age representation and does not independently verify your age. You acknowledge that BookNStyle LLC would not permit you to create an account, book a Professional, or receive services through the platform if you were under 18, and that Professionals likewise rely on your representation when accepting your booking.

IF YOU MISREPRESENT YOUR AGE: (A) YOU ARE IN MATERIAL BREACH OF THESE TERMS AND WE MAY SUSPEND OR PERMANENTLY TERMINATE YOUR ACCOUNT AND ANY RELATED ACCOUNTS; (B) TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU RELEASE, WAIVE, AND COVENANT NOT TO SUE BOOKNSTYLE LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AND AGENTS FOR ANY CLAIM, DEMAND, OR CAUSE OF ACTION ARISING FROM OR RELATED TO YOUR HAVING BEEN UNDER 18 YEARS OF AGE WHEN YOU USED THE SERVICES OR RECEIVED SERVICES FROM A PROFESSIONAL, INCLUDING ANY CLAIM THAT BOOKNSTYLE LLC SHOULD HAVE PREVENTED SUCH USE OR SERVICES; AND (C) YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS BOOKNSTYLE LLC FROM ANY CLAIMS, LOSSES, LIABILITIES, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES) ARISING FROM YOUR MISREPRESENTATION, INCLUDING CLAIMS BROUGHT BY OR ON BEHALF OF A MINOR, A PARENT OR GUARDIAN, OR A PROFESSIONAL.

Professionals must also be at least 18 years old and are solely responsible for complying with all laws governing the services they provide, including laws that prohibit or restrict providing certain services (for example, tattooing, body art, or permanent makeup) to minors, and any requirement to verify a Client's age or obtain identification before providing a service. A Professional who has reason to believe a Client is under 18 must decline the booking and report it to support@booknstyle.com.

If we learn that a User is under 18, we will terminate the account and delete associated personal information as described in our Privacy Policy. Nothing in this section limits any right that cannot be waived under applicable law.

Account Termination and Deletion

You may delete your account at any time from within the app (Account → Delete account) or by contacting us at support@booknstyle.com. Deleting your account removes your profile and associated personal data from our active systems, subject to information we are required to retain for legal, tax, fraud-prevention, or dispute-resolution purposes.

BookNStyle may suspend or terminate your account, with or without notice, if you violate these Terms, pose a fraud or credit risk, provide false information, or engage in unlawful or harmful conduct, or for any other reason in our reasonable discretion.

Upon termination: (a) you remain bound by the surviving provisions of these Terms; (b) you must stop using the Services; (c) licenses granted to you end; and (d) we may delete or retain your data as needed to comply with law. Termination does not relieve you of any fees accrued before termination.

BookNStyle is not liable for losses relating to chargebacks, fraudulent charges, or other deceptive or invalid actions by any User. We may terminate any account that engages in or enables fraudulent activity.

Fees and Payments

When you book with a Professional, you pay (a) the Professional's service price, set by the Professional, and (b) a flat booking fee of $1.99 per appointment to BookNStyle. The booking fee is BookNStyle's charge for providing you access to the BookNStyle marketplace — including the ability to discover, compare, and connect with Professionals — and for facilitating the booking transaction. Because these services are provided at or before the time of booking, the booking fee is earned when your appointment is booked and is not refunded to your payment method, regardless of who cancels the appointment or why, except where a refund is required by applicable law. If the Professional cancels, the booking fee you paid is instead returned to you as a booking credit, as described under "Cancellation and no-show terms" below.

Payment authorization. When you book, you authorize us and our payment processor to charge your selected payment method for the Professional's service price (or deposit, if the service requires one) plus the $1.99 booking fee (unless a booking credit covers it) and any applicable tip. The full total is shown to you before you confirm.

Card on file, deposits, and cash. When you book with a card, the $1.99 booking fee is charged at booking and your card is securely saved by our payment processor. If a booking credit covers the booking fee, nothing is charged at booking, but your card is still saved. The service price is authorized (held) on that card up to 48 hours before the appointment and charged after the appointment is completed — when the Professional marks it complete, or automatically 1 hour after the scheduled end time. If something goes wrong, you can report a problem in the app, which opens a support request; reporting does not pause the charge, but BookNStyle may issue a full or partial refund after review. If the Professional requires a deposit, the deposit is charged immediately at booking and the remaining balance is paid in person. Each Professional decides, per service, whether the deposit is refundable if you cancel, and you are shown which before you confirm. Some Professionals operate on a cash-only basis; in that case, only the $1.99 booking fee is charged at booking, and you pay the Professional in person for the service.

Professional cancellation policy. Each Professional sets their own written cancellation policy, which is displayed to you on the booking screen before you confirm. By tapping Pay, you agree to abide by that Professional's cancellation policy in addition to these Terms. Cancellation policies vary by Professional — read each pro's policy carefully before booking.

Cancellation and no-show terms. If a Professional cancels an appointment, any deposit you paid is refunded to you in full, any hold on your card is released, and any service price already captured is refunded. The booking fee is not refunded to your card; instead, the amount you paid for it (or the booking credit you used for it) is added to your account as a booking credit. Booking credits do not expire, have no cash value, and are applied automatically to the booking fee on your next booking with any Professional. Before cancelling, a Professional may propose a new time instead; if you accept it, your appointment is rescheduled and no credit is issued. If you cancel before the scheduled start time, a deposit the Professional has marked refundable is refunded to you in full, and a deposit marked non-refundable is retained by the Professional. If you do not show, any deposit is retained by the Professional. In addition, if you cancel within twenty-four (24) hours of the scheduled start time, the Professional may, at the Professional's sole discretion and in accordance with their cancellation policy, charge a late-cancellation fee to the payment method you used at booking. The Professional decides whether to charge such a fee and the amount, up to the full service price. You will be notified by push notification and email if such a fee is charged. The Professional may also, at the Professional's discretion, issue a full or partial refund of any deposit retained or any cancellation fee charged; you will be notified the same way.

Rescheduling. You may reschedule a confirmed booking yourself in the app once per booking, free of charge, to another open time with the same Professional, as long as you do so before that Professional's reschedule cutoff (a time before the appointment that each Professional sets, 24 hours by default, and that the app shows you). A reschedule moves your existing booking: the booking fee, any deposit, and any booking credit stay with it, and a reschedule never creates a new charge or a refund. If the service price has already been authorized (held) on your card, that hold may be released and placed again closer to the new time. After you have used your free reschedule, or once the cutoff has passed, you cannot reschedule that booking yourself; you may contact the Professional, or cancel the booking and make a new one, in which case the cancelled booking's fee is not refunded and the new booking has its own booking fee. A Professional may also propose a new time for your booking; nothing changes unless you accept it, you may decline it, and accepting it does not use your free reschedule.

BookNStyle reserves the right to change, raise, or otherwise modify the booking fee or any other fee charged to Clients under these Terms at any time. Fees support the operational cost of operating the marketplace, providing a smooth, secure booking experience, and the ongoing maintenance, development, and reliability of the platform. BookNStyle will provide reasonable advance notice of any fee change through the Services, by email, or by other means it determines appropriate. Continued use of the Services after a fee change becomes effective constitutes acceptance of the new fee.

All amounts are denominated in United States dollars.

Payment Processing

Payments are processed by our third-party payment service provider, Stripe, Inc. ("Stripe"). By using the Services you agree to be bound by the Stripe Terms of Service, as Stripe may modify them from time to time.

BookNStyle facilitates payment transactions between Clients and Professionals but is not a bank and does not provide banking services. BookNStyle is not responsible for errors made by third-party payment processors. We may, in our discretion, place holds on payments or arrange refunds or credits to correct errors or address extenuating circumstances, but we have no general obligation to provide refunds.

We accept most US-issued and many non-US-issued credit, debit, prepaid, and gift cards bearing a Visa, MasterCard, Discover, or American Express logo. Where available on your device, you may also pay using Apple Pay, Google Pay, or supported pay-over-time methods. We may add or remove accepted payment methods at any time.

We may decline to authorize or settle any transaction we believe violates these Terms or exposes Users, our payment processor, or the Company to harm, including fraud. If we suspect unauthorized or illegal use, you authorize us to share information about you and your transactions with law enforcement, and you agree to provide information and assistance we reasonably request as part of transaction or account reviews.

Customer Care and Disputes

Professionals are solely responsible for all customer-service matters relating to their services, including pricing, fulfillment, cancellations, returns, refunds, adjustments, and service quality.

As between Clients and BookNStyle, BookNStyle is responsible only for customer-service matters relating to your BookNStyle account, payment processing, and platform functionality.

BookNStyle provides a dispute process through which either party may raise a concern about a booking within the window shown in the app. Our support team aims to respond within the service-level commitment shown in the app. BookNStyle may resolve disputes by issuing a full refund, a partial refund, or no action, in its reasonable discretion. BookNStyle is not obligated to mediate disputes and is not responsible for the outcome of interactions between Users.

Acceptable Use

You agree to follow all applicable laws and to take full responsibility for any promotion or content you offer through the Services.

You agree NOT to: send unauthorized commercial communications (spam); collect User content or access the Services using automated means without our permission; engage in unlawful multi-level marketing; upload viruses or malicious code; solicit login credentials or access another person's account; bully, intimidate, or harass any User; post content that is hateful, threatening, pornographic, or that contains nudity or graphic violence; market alcohol-related or other mature content; use the Services for anything unlawful, misleading, malicious, or discriminatory; do anything that could disable or impair the Services; or facilitate any violation of these Terms.

You agree to keep your registration and contact information accurate and up to date, and to keep your account credentials confidential.

Objectionable content and abusive users are not tolerated. You can report objectionable content or abusive behavior from within the app or by emailing support@booknstyle.com. We review reports and may remove content or remove users who violate these Terms, typically within 24 hours of a report.

Health Information Notice

Do not share protected health information through the Services. The Services are not intended for the communication of protected health information and are not designed to comply with the Health Insurance Portability and Accountability Act (HIPAA). If you choose to share such information, you do so at your own risk.

Content and Intellectual Property

The Services contain content and technology owned by BookNStyle and protected by copyright, trademark, patent, trade secret, and other laws (the "Company Property"). You may not copy, modify, or reverse engineer any part of the Services or the Company Property. The Services are licensed, not sold.

By posting photos, text, or other materials ("Content") to the Services, you represent that you have the right to do so, and you grant BookNStyle a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, reproduce, modify, adapt, display, and create derivative works of that Content in connection with operating and promoting the Services. This license ends when you remove the Content, except where we must retain it to comply with law or for a legitimate investigation.

You retain ownership of the Content you post. We may remove or hide any Content at our discretion.

If you believe your copyright or other intellectual property right has been infringed on the Services, send a notice to legal@booknstyle.com including: your signature; identification of the work claimed to be infringed; identification of the infringing material and its location in the app; your contact information; a statement of good-faith belief that the use is not authorized; and a statement, under penalty of perjury, that your notice is accurate and that you are authorized to act.

Communications

By creating an account, you agree to receive transactional and informational messages from BookNStyle and from Professionals you book with — including booking confirmations, reminders, reschedule requests, waitlist alerts, and receipts — by push notification and email, which may be sent using automated technology.

You can manage push notifications in your device settings and in Notifications in the app. We do not currently send text messages. If we add them, we will ask for your consent first, and you will be able to opt out at any time by replying STOP.

BookNStyle may also send you product and service updates. You can opt out of marketing messages at any time without affecting transactional messages necessary to operate your bookings.

Disclaimers

YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS AND FOR TAKING REASONABLE PRECAUTIONS IN ALL INTERACTIONS AND IN THE PROVISION OR RECEIPT OF SERVICES.

BOOKNSTYLE IS NOT OBLIGATED TO AND DOES NOT ROUTINELY SCREEN USERS OR VERIFY INFORMATION THEY PROVIDE. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, BOOKNSTYLE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

BOOKNSTYLE MAKES NO WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. BOOKNSTYLE MAKES NO REPRESENTATION REGARDING THE QUALITY, SUITABILITY, RELIABILITY, OR LEGALITY OF ANY SERVICES OFFERED BY PROFESSIONALS OR THE LICENSING OF ANY PROFESSIONAL.

Limitation of Liability and Release

TO THE FULLEST EXTENT PERMITTED BY LAW, BOOKNSTYLE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR BODILY INJURY, EMOTIONAL DISTRESS, OR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING FROM: YOUR USE OF OR INABILITY TO USE THE SERVICES; SERVICES FACILITATED BY THE PLATFORM OR INTERACTIONS BETWEEN USERS; THE CONDUCT OF ANY USER OR THIRD PARTY; OR UNAUTHORIZED ACCESS TO YOUR DATA.

BECAUSE BOOKNSTYLE IS NOT INVOLVED IN THE ACTUAL INTERACTIONS BETWEEN PROFESSIONALS AND CLIENTS OR IN THE PROVISION OF SERVICES, YOU RELEASE AND DISCHARGE BOOKNSTYLE AND ITS AFFILIATES FROM ANY AND ALL CLAIMS AND DAMAGES, KNOWN OR UNKNOWN, ARISING FROM OR RELATED TO ANY DISPUTE OR INTERACTION WITH ANOTHER USER.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnification

You agree to defend, indemnify, and hold harmless BookNStyle and its affiliates, officers, directors, employees, agents, partners, and licensors from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to: your use of the Services; services facilitated by the platform or your interactions with another User; your violation of these Terms; your misrepresentation of your age or eligibility; your violation of any third-party right; or any third-party claim relating to death, personal injury, or emotional distress connected to your use of the Services. This obligation survives termination of these Terms.

Dispute Resolution and Arbitration

Informal resolution: Before initiating arbitration or a court proceeding, you and BookNStyle agree to attempt to resolve any dispute informally for at least 30 days after written notice. Notice to BookNStyle should be sent to legal@booknstyle.com.

Binding arbitration: If informal resolution fails, most disputes will be resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules and, where applicable, its Consumer Arbitration Rules. The seat of arbitration is Nassau County, New York; however, you may elect to participate by telephone, by videoconference, or on the basis of written submissions alone, and you may request that any in-person hearing be held in the county where you live. IF EITHER PARTY ELECTS ARBITRATION, NEITHER PARTY WILL HAVE THE RIGHT TO A COURT TRIAL OR JURY TRIAL.

Class action waiver: You and BookNStyle agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding, to the maximum extent permitted by law.

Exceptions: Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief for intellectual-property infringement. Claims that applicable law prohibits from being arbitrated are excluded from the arbitration requirement.

You may opt out of this arbitration agreement by emailing legal@booknstyle.com within 30 days of first accepting these Terms.

Additional Terms for Professionals

The following sections apply to Professionals who list services on BookNStyle. They are in addition to the terms above, which apply to everyone. Professionals also see these terms in the app before creating an account.

BookNStyle Pro Subscription

To list services and receive new bookings on the Services, you must maintain an active BookNStyle Pro subscription. Your services will not appear in Client search results and you will not receive new bookings while your subscription is inactive.

Subscription pricing. The Pro subscription is currently offered at $20.00 per month (billed monthly) or $216.00 per year (billed once annually — a 10% discount, $24.00 less than twelve months of monthly billing).

Free trial. New Professional accounts receive a one-month free trial. A valid payment method is required to start the trial. You will not be charged during the trial; your first charge occurs on the same calendar day of the following month (or the last day of that month if no such day exists) unless you cancel before then. One free trial per Professional.

Billing and renewal. After the free trial, the subscription renews automatically using the payment method on file: monthly plans are charged every month on the same calendar day as your first charge, and annual plans are charged once a year on the same calendar date as your first charge. Subscription fees are payable in advance and are non-refundable except where required by law or where BookNStyle expressly elects to issue a refund in its discretion.

Cancellation by the Professional. You may cancel your subscription at any time from the in-app subscription screen. Upon cancellation, your subscription remains active and you retain full access through the end of the then-current billing period (monthly or annual). At the end of that period the subscription ends, no further charges are made, your services are removed from Client search results, and you will not receive new bookings until you resubscribe. Subscription fees are not pro-rated upon cancellation.

Effect on existing bookings. Bookings confirmed before your subscription ends continue to be honored. You remain obligated to perform or refund those appointments and you remain entitled to the service-price payments associated with them, subject to the booking terms applicable to each appointment.

Right to change subscription pricing. BookNStyle reserves the right to change, raise, or otherwise modify the Pro subscription price or any other fee under these Terms at any time. Fees support the operational cost of operating the marketplace, providing a smooth, secure booking experience, and the ongoing maintenance, development, and reliability of the platform. BookNStyle will provide reasonable advance notice of any price change through the Services, by email, or by other means it determines appropriate; for the auto-renewing subscription, any price change will take effect at the start of the next billing period after notice. Continued use of the Services or continuation of the auto-renewing subscription after a price change becomes effective constitutes acceptance of the new price. To decline a price change, you must cancel your subscription before the change takes effect.

Booking Fees, Payouts, and Pro Discretion

Client booking fee. In addition to the Professional service price, each Client pays a flat booking fee of $1.99 per appointment to BookNStyle. The booking fee is BookNStyle's charge to the Client for marketplace access and for facilitating the booking transaction; you do not receive any portion of it.

Service price and card processing. BookNStyle does not take a commission on service prices, tips, or any cancellation fee you charge; the service price is set solely by you. Standard card-processing costs (currently 2.9% plus $0.30 per card transaction, the rate charged by our payment processor) are deducted from each card payment routed to you — service payments, deposits, tips, and cancellation fees — before transfer to your connected account. Cash-mode bookings carry no processing cost to you.

Payment capture. For card bookings, the Client's card is saved at booking; the service price is authorized up to 48 hours before the appointment and captured to your Stripe-connected balance when you mark the appointment complete in the app, or automatically 1 hour after the scheduled end time. If the Client reports a problem, BookNStyle opens a support request; the charge is not paused, and BookNStyle may refund the Client in full or in part after review, with any refund debited from your connected balance. If the service is configured to require a deposit, the deposit is captured immediately at booking and routed to your connected balance; the remaining balance is collected by you in person. If you operate in cash mode, only the $1.99 booking fee is charged to the Client at booking and you collect the service price in cash in person.

Deposits. You decide per service whether a deposit is required, and you decide whether the deposit is a flat dollar amount or a percentage of the service price. Deposits help reduce no-shows and protect your schedule. The Client is shown the deposit amount and the in-person remainder before confirming the booking. You also decide per service whether the deposit is refundable if the Client cancels: a refundable deposit is refunded to the Client in full when the Client cancels before the scheduled start time, and a non-refundable deposit is kept by you. If you cancel a confirmed booking, any deposit or service payment captured from the Client is automatically refunded to the Client in full, whatever the service's deposit setting, and that refund is debited from your connected (payout) balance, together with the card-processing cost of the original payment. The Client's booking fee is not refunded to their card; BookNStyle gives the Client a booking credit toward their next booking instead. Before cancelling, you may propose a new time; if the Client accepts, the booking is rescheduled instead. Clients may also reschedule a booking themselves once, free of charge, to another open time on your calendar, until the reschedule cutoff you choose in your profile (24 hours before the appointment by default); a rescheduled booking keeps its booking fee and any deposit.

Your written cancellation policy. You may publish a written cancellation policy from your profile, which is shown to Clients on the booking screen. By tapping Pay, each Client agrees to abide by your policy in addition to the BookNStyle Terms. You should keep your policy accurate, reasonable, and consistent with the cancellation fees you actually charge. If you do not publish a policy, Clients are told that late cancellations and no-shows may be charged at your discretion.

Late-cancellation fees (pro discretion). If a Client cancels within twenty-four (24) hours of the scheduled start time, you may, at your sole discretion and within seventy-two (72) hours of the cancellation, charge that Client a late-cancellation fee in any amount up to the full service price, in accordance with your stated cancellation policy. The fee is billed off-session to the Client's saved payment method, routed in full to your connected balance, and 100% retained by you (BookNStyle does not take a cut). You are responsible for using this discretion in good faith, consistent with applicable consumer-protection laws and the cancellation policy you have published to Clients. Charging or declining to charge a late-cancellation fee is a business judgment by you, not by BookNStyle.

Refunds (pro discretion). You may, at your discretion, issue a full or partial refund of any deposit you have retained or any late-cancellation fee you have charged, from the in-app pro bookings screen. Refunds are debited from your connected balance. The Client is notified of any refund you issue.

Platform charges to Professionals. You authorize BookNStyle and its payment processor to charge the payment method on file for your BookNStyle Pro subscription, or to debit your connected (payout) balance, for amounts you owe BookNStyle under these Terms, including: (a) a late-cancellation charge of $1.99 when you cancel a confirmed booking within twenty-four (24) hours of its scheduled start time, if BookNStyle has turned this charge on (the app tells you when it applies); and (b) any card-processing cost on a refund you owe to a Client that is more than the processing amount already deducted from the original payment (for example, on some international cards). If a charge fails, BookNStyle may retry it or deduct it from a future payout.

Tips. Tips are processed as a separate transaction at the Client's discretion after the appointment. You receive 100% of every tip (no platform fee).

Right to change fees. BookNStyle reserves the right to change, raise, or otherwise modify the Client booking fee or any other fee under these Terms at any time, on the same notice terms described above for the Pro subscription.

All amounts are denominated in United States dollars.

Payment Processing and Stripe Connect

Payments are processed by our third-party payment service provider, Stripe, Inc. ("Stripe"). By using the Services as a Professional you agree to be bound by the Stripe Connected Account Agreement and the Stripe Terms of Service (collectively, the "Stripe Services Agreement"), as Stripe may modify them from time to time.

You receive payouts through Stripe Connect. You must complete Stripe's onboarding and identity-verification process before accepting card-mode or deposit-mode bookings. Cash-mode bookings collect only the $1.99 booking fee from the Client and do not require a Stripe Connect account, but features that capture funds to you (deposits, late-cancellation fees, tips) require an active Stripe Connect account in good standing.

BookNStyle is not a party to the agreement between you and Stripe and has no liability under it. BookNStyle facilitates payment transactions between Clients and Professionals but is not a bank and does not provide banking services. BookNStyle is not responsible for errors made by third-party payment processors. We may, in our discretion, place holds on payments or arrange refunds or credits to correct errors or address extenuating circumstances, but we have no general obligation to provide refunds.

Taxes. You are solely responsible for determining the taxes, withholdings, and other amounts you owe in connection with your services, and for collecting, remitting, and reporting them to the appropriate tax authorities. We do not give tax advice and are not liable for any tax determination, payment, or reporting.

General

Governing law: These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules, except where preempted by federal law.

Venue: Subject to the arbitration provisions above, you and BookNStyle agree that any claim not resolved in arbitration will be brought exclusively in the state or federal courts located in Nassau County, New York, and each party consents to the personal jurisdiction of those courts. Nothing in this paragraph limits a consumer's right, where applicable law provides one, to bring a claim in the courts of their own place of residence.

Apple and Google: If you download the app from the Apple App Store or Google Play, you also agree to the applicable platform terms. These Terms are between you and BookNStyle only, not with Apple or Google, and those platforms are not responsible for the app or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and BookNStyle regarding the Services.
